A WorkCover claim rejected in Queensland isn't the end of the road. How the review and appeal process works, and how to get a claim reinstated.
Having a WorkCover claim knocked back by the insurer is gutting news — especially when you’re injured, off work and watching the bills stack up. But a rejection is not a dead end. Many knocked-back claims are overturned. Here’s how the process works in Queensland.
Why claims get knocked back
Rejections usually come down to one of a few things:
- The insurer says your injury didn’t arise out of your employment.
- There’s a dispute over whether work was a significant contributing factor.
- Medical evidence was incomplete or didn’t clearly link the injury to your work.
- A missed deadline or paperwork problem.
Notice that most of these are about evidence and framing — not about whether you’re genuinely hurt. That’s exactly why the right medical and legal material can change the outcome.
Step 1: Ask for a review
If your claim is rejected, you can apply to have the decision reviewed by the regulator (the Workers’ Compensation Regulator). There’s a time limit on this — generally three months from the decision — so don’t sit on the letter.
A review is your chance to put in the evidence that was missing the first time: a clearer report from your treating doctor, a statement about how the injury actually happened, and the legal argument connecting the two.
Step 2: Appeal if needed
If the review still doesn’t go your way, you may be able to appeal to the Queensland Industrial Relations Commission. This is a more formal step, and it’s where having a lawyer genuinely matters.
Don’t forget your common law rights
Getting the statutory claim accepted is often only half the picture. If your employer’s negligence contributed to your injury, you may also have a common law damages claim — which can be worth significantly more than statutory benefits.
Critically, accepting certain lump-sum offers can affect or extinguish that larger claim. Get advice before you sign anything.
